1. About these terms
These Terms of Service apply when you visit or make a purchase from the Mini Fish website at minifish.com.au.
The website and Mini Fish brand are operated by Fish Toys Australia Pty Ltd, referred to in these terms as “Mini Fish”, “we”, “us” or “our”.
By accessing our website or placing an order, you agree to these Terms of Service and any policies referred to within them, including our:
- Returns and Refunds Policy
- Shipping Policy
- Privacy Policy
If you do not agree to these terms, you should not use the website or place an order.
These terms apply to retail purchases made through our website. Wholesale purchases may be subject to separate wholesale terms.
2. Australian Consumer Law
Our products come with guarantees that cannot be excluded under Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or protection you may have under Australian Consumer Law or any other law that cannot legally be excluded.
Where there is any inconsistency between these terms and your rights under Australian Consumer Law, your rights under Australian Consumer Law will apply.
3. Using our website
You may use our website only for lawful purposes.
You must not:
- Use the website for fraudulent or unlawful activity
- Attempt to interfere with the website’s security or operation
- Introduce viruses, malicious code or other harmful material
- Attempt to access another customer’s account or personal information
- Scrape, copy or reproduce website content for commercial purposes without permission
- Use our products, images, designs or branding in a misleading or unauthorised way
You must be at least 18 years old to place an order, or have permission from a parent or legal guardian.
We may restrict access to the website where reasonably necessary to protect our customers, business or website security.
4. Product information
We aim to ensure that product descriptions, photographs, measurements, prices and other information on our website are accurate.
Mini Fish figurines and keyrings are detailed, hand-painted products. Small variations in colour, paint placement, finish or detailing may occur between individual products. Product colours may also appear slightly different depending on your screen or device.
These minor variations are part of the manufacturing and hand-painting process and will not generally be considered faults. This does not affect your rights where a product fails to meet a consumer guarantee under Australian Consumer Law.
Unless clearly stated otherwise, accessories, backgrounds, books, mats, fish figurines, keyrings and other items shown in lifestyle photographs are not included with a product. The written product description explains what is included.

5. Product safety and care
Products must be used in accordance with any age recommendations, safety warnings, care instructions and other information supplied with the product or displayed on our website.
Children should be supervised as appropriate for their age and the product being used. Packaging and any small or detachable components should be kept away from children where they may present a choking or suffocation risk.
Products should not be placed in a child’s mouth or used for any purpose other than their intended use.
We are not responsible for damage caused by misuse, improper storage, unauthorised modification, failure to follow care instructions or ordinary wear and tear. This does not limit rights that cannot legally be excluded.
6. Prices and payment
Unless stated otherwise:
- Prices are displayed in Australian dollars
- Australian retail prices include GST where applicable
- Shipping charges are calculated separately and displayed at checkout
- Any international taxes, duties or import charges are the customer’s responsibility unless stated otherwise
You must pay the full amount shown at checkout using one of the available payment methods.
Payment services may be provided by Shopify or another third-party payment provider. Your use of those services may also be subject to the provider’s own terms and privacy practices.
We may change our prices at any time. A price change will not affect an order that we have already accepted.
7. Pricing and website errors
We take reasonable care to keep our website information accurate. However, occasional pricing, stock, description or technical errors may occur.
If we discover an obvious error before accepting or dispatching your order, we may contact you to:
- Confirm whether you would like to proceed at the correct price or with the corrected information; or
- Cancel the affected item or order and provide a full refund
We will not charge you an increased price without your agreement.
8. Orders and order acceptance
After you place an order, you should receive an order confirmation. This confirms that we have received your order but does not necessarily mean that it has been accepted or dispatched.
An order is accepted when we send you confirmation that it has been dispatched.
We may decline or cancel an order before dispatch for a legitimate reason, including:
- The product is unavailable
- A pricing or product information error has occurred
- We cannot deliver to the supplied address
- Payment has not been authorised
- The order appears fraudulent or unauthorised
- Purchase limits or promotional conditions have been breached
- We are legally unable to supply the order
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.
We may apply reasonable purchase limits to products where necessary to manage limited stock, prevent unauthorised resale or ensure fair access to a promotion.
9. Customer information
You must provide accurate and complete information when placing an order, including your name, email address, delivery address and payment information.
Please check your delivery details carefully before completing checkout.
Contact us as soon as possible if you discover an error. We will try to update the order, but changes may not be possible once an order has been processed or dispatched.
Where an incorrect or incomplete address supplied by the customer causes an order to be returned or requires redelivery, we may charge the reasonable cost of resending the order. This will not apply where the addressing error was caused by Mini Fish.
10. Shipping and delivery
Shipping costs and available delivery options will be shown at checkout or explained in our Shipping Policy.
Delivery times are estimates only. Delays may occur due to carriers, weather, public holidays, remote delivery locations, customs processing or other circumstances outside our reasonable control.
We will take reasonable steps to assist where an order is significantly delayed, lost or damaged in transit.
Responsibility for the product passes to you when it is delivered to the delivery address you supplied or collected by you from an authorised collection point.
If tracking shows that an order has been delivered but you cannot locate it, please check around the property and with other household members before contacting us. We will assist you to investigate the delivery with the carrier.
11. Order changes and cancellations
Contact us as soon as possible if you need to change or cancel an order.
We will try to assist, but we cannot guarantee that an order can be changed or cancelled after it has entered processing or been dispatched.
Cancelling an order because you no longer want it is considered a change of mind. Our change-of-mind conditions are explained in our Returns and Refunds Policy.
12. Returns, replacements and refunds
Please choose carefully, as Mini Fish does not accept returns or provide refunds for a change of mind.
We will provide an appropriate remedy where a product is faulty, damaged, unsafe, incorrectly supplied or otherwise fails to meet a consumer guarantee under Australian Consumer Law.
For a minor problem, we may provide a replacement product or replacement component within a reasonable time.
For a major product failure, you may be entitled to choose between a replacement and a refund.

13. Promotions and discount codes
Promotions, competitions, bundles, free gifts and discount codes may be subject to additional conditions displayed at the time of the offer.
Unless stated otherwise:
- Discount codes cannot be exchanged for cash
- Only one discount code may be used per order
- Discounts cannot be applied after an order has been placed
- Promotions apply only during the advertised period
- Promotions are subject to product availability
- Free-shipping offers apply only to eligible delivery locations and qualifying order values
- Returned or cancelled items may affect whether an order still qualifies for a promotion or free gift
We may withdraw or correct a promotion where there has been a genuine error, technical issue, misuse or fraudulent activity. This does not affect orders that have already been validly accepted, except where permitted by law.
14. Gift cards and store credit
Gift cards and store credit, where offered, may be used only through the Mini Fish store and cannot be redeemed for cash except where required by law.
Expiry dates and other conditions will be displayed when the gift card or store credit is issued.
You are responsible for keeping gift card details secure. Please contact us promptly if you believe a gift card has been lost, stolen or used without permission.
15. Reviews and customer content
You may have the opportunity to submit a product review, photograph, comment or other content.
Content submitted must be truthful, relevant and must not:
- Infringe another person’s intellectual property or privacy rights
- Contain unlawful, abusive, misleading or discriminatory material
- Include malicious software or harmful links
- Promote unrelated products or services
- Contain another person’s private information without permission
We may moderate or remove content where reasonably necessary, but we will not remove a genuine negative review merely because it is unfavourable.
Where you submit content directly to Mini Fish for publication, you give us a non-exclusive, royalty-free permission to display and reproduce that content in connection with our website, products and marketing. You confirm that you own the content or have permission to provide it.
This section does not automatically give us permission to use photographs or videos from your private account or unrelated social media posts.
16. Intellectual property
The content on our website, including the Mini Fish name, branding, logos, product designs, fish artwork, photographs, illustrations, graphics, written content and website layout, is owned by or licensed to Fish Toys Australia Pty Ltd.
You may view and use the website for your personal, non-commercial shopping purposes.
You must not copy, reproduce, modify, distribute, sell, manufacture from, create derivative products from or commercially use our intellectual property without prior written permission.
Purchasing a Mini Fish product does not transfer ownership of any intellectual property relating to the product or its design.
17. Third-party services and links
Our website may include links to or integrations with third-party services, including payment providers, shipping carriers, social media platforms and review services.
Third-party websites and services are operated independently from Mini Fish. Their own terms, privacy policies and practices may apply.
We are not responsible for third-party content or services except to the extent that responsibility cannot legally be excluded.
18. Website availability
We aim to keep our website available and operating correctly. However, access may occasionally be interrupted for maintenance, updates, technical problems or circumstances outside our reasonable control.
We do not guarantee that the website will always be uninterrupted or free from technical errors.
We may update, suspend or discontinue part of the website where reasonably necessary. This does not affect any order that has already been accepted.
19. Liability
To the maximum extent permitted by law, Mini Fish is not responsible for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.
We do not exclude liability for:
- Consumer guarantees under Australian Consumer Law
- Personal injury or property damage caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot legally be excluded or limited
Where the law allows us to limit a remedy for a failure that is not a major failure, our liability may be limited to replacing the affected product, repairing it, supplying an equivalent product or paying the reasonable cost of doing so.
20. Privacy
We collect, use and protect personal information in accordance with our Privacy Policy.
Our store is hosted by Shopify, and Shopify and other service providers may process information to provide website, checkout, payment, fraud-prevention and related services.

21. Resolving concerns
Please contact us first if you have a concern about an order, product or use of the website. We will make reasonable efforts to resolve the matter promptly and fairly.
Nothing in this section prevents you from contacting a consumer protection agency, bringing a claim or exercising any other legal right available to you.
22. Governing law
These terms are governed by the laws of Queensland and the Commonwealth of Australia.
You and Mini Fish submit to the courts and tribunals that have jurisdiction in Queensland, subject to any rights you may have to bring a matter in another jurisdiction under applicable consumer law.
23. Changes to these terms
We may update these Terms of Service from time to time to reflect changes to our website, products, business practices or legal obligations.
The current version will be published on our website with the date it was last updated.
Changes will apply from the date they are published and will not retrospectively change the terms applying to an order that was already accepted.
24. Severability
If part of these terms is found to be invalid or unenforceable, that part will be removed or limited to the minimum extent necessary. The remaining parts will continue to apply.
